Blockbrief's monthly zoning alerts tracks zoning changes in NSW and Victoria. In February, 9 councils in NSW rezoned land, while 16 councils across Victoria rezoned land.

 

 

NSW

Local Environmental Plans 

In NSW, Local Environmental Plans (LEPs) guide planning decisions for local government areas. Through zoning and development controls, they allow councils and other consent authorities to manage the ways in which land is used. LEPs are the primary planning tools that shape the future of communities.

Principal LEP

An LEP applies to a particular area, generally the whole or part of  a Local Government Area (LGA). An LEP that applies to an enitre LGA is referred to as the principal LEP. Principal LEPs review an LGA's current zonings and controls. It is the result of LGA wide strategic planning. In February, 1 council across the State enacted a new LEP and as a result new zonings.

Amending LEP

An LEP being made to amend a principal LEP is referred to as an amending LEP. In February, 8 councils across the State amended their LEPs which affected zonings.

 

Amending LEP’s

Bathurst Regional (Interim) Local Environmental Plan 2005 (Amendment No 7) Rezones land around the urban village of Eglinton from 1(a) – Inner Rural and 1(b) – Market Garden to 2(a) – Residential. To allow the development of an estimated 637 residential lots.
Blacktown Local Environmental Plan (Central Business District) 2012 The LEP affects all land identified within the Blacktown CBD.
Camden Local Environmental Plan Amendment (Sydney Region Growth Centres—Oran Park and Turner Road Precincts) 2013 Rezones riparian areas and adjoining land in both Precincts to Zones R1 General Residential, R3 Medium Density Residential, E4 Environmental Living and RE2 Private Recreation. Also, realigns the zoning boundary for employment land in the Turner Road Precinct, between Zones IN1 General Industrial, B5 Business Development and R1 General Residential.
Gosford Local Environmental Plan No 481 Permits caravan parks and relocatable/manufactured homes on land currently zoned 2(c) Residential. The site is located at 75-83 Karalta Road, Erina.
Mid-Western Regional Local Environmental Plan 2012 (Amendment No 2) Amends Lot size maps and Zoning maps to correct anomalies between proposed and published maps.
Murray Local Environmental Plan 2011 (Amendment No 2) Applies a lot size of 5000sqm to part of an area known as the ‘Maiden Smith Drive Estate’ in the township of Moama.
Tamworth Regional Local Environmental Plan 2010 (Amendment No 2) Rezones Lot 1 DP 803644, 89 Marius Street, Tamworth from IN1 General Industrial to B4 Mixed Use.  > Property ID 824
Botany Local Environmental Plan 1995 (Amendment No 41) Enables the reclassification of four parcels of land in Botany Bay LGA from community to operational land.

 

VICTORIA

Planning Scheme

In Victoria, a planning scheme is a legal instrument that sets out the provisions for land use and development. Victoria has 81 planning scheme areas and therefore has 81 planning schemes. Planning schemes are amended on a regular basis. A planning scheme amendment may involve a change to a planning scheme, which often includes rezonings.

Amendments can be:

  • C amendments (changes to council planning schemes only)
  • VC amendments (changes to VPP and council planning schemes)
  • V amendments (changes to VPP only).
In February, 16 councils across the State amended their planning schemes which affected zonings.

Ballarat Planning Scheme Amendment C159 Rezones 1131 and 1133 Norman Street and 68 and 70 Park Streeet, Wendouree from Residential 1 Zone to Business 1 Zone and applies Road Closure Overlay to northern end of Park Street road reserve, Wendouree > Property ID 807
Banyule Planning Scheme Amendment C082 The Amendment introduces the Activity Centre Zone into the Banyule Planning Scheme and applies Schedule 1 of the Activity Centre Zone to the Greensborough Principal Activities Area to accord with the adopted structure plan for the area.
Bass Coast Planning Scheme amendment C078 Part 2 Deletes Public Acquisition Overlay and applies Public Use Zone to land owned by Westernport Water for Candowier Reservoir in Almurta, and corrects minor mapping and text anomalies.
Brimbank Planning Scheme Amendment C121 Rezones land at 197 Taylors Road, St Albans from Industrial 3 Zone to Residential 1 Zone.  > Property ID 811
Cardinia Planning Scheme Amendment C165 Amendment requested by Council to introduce a site specific control under Clause 52.03 to allow the subdivision of 22-30 Downey Road, Dewhurst into two lots.
Casey Planning Scheme Amendment C160 Rezones part of land at 110 Grices Road, Berwick from Low Density Residential Zone (LDRZ) to a Residential Zone (R1Z).  > Property ID 812

Wyndham Planning Scheme Amendment C137 Rezones 1.89 hectares of land in Featherbrook Estate, Point Cook from Residential 1 Zone to Business 1 Zone, amends the Schedule to the Business 1 Zone.
Yarra Range Planning Scheme Amendment C130 Rezones 215-217 Victoria Road, Yering to Special Use Zone (SUZ9) and incorporate the document Eastern Golf Club into the planning scheme.
