State Government and Local Council To Battle Over Land Release In the Hunter

Muswellbrook Council, in the Upper Hunter Region of New South Wales, resolved to adopt its West Denman Development Control Plan this week, which will see 750 residential lots rolled out in stages over the next 10 years. However, the Department of Trade and Investment’s Resources and Energy Division has taken exception to the plan, arguing that the land’s coal resource potential outweighs the housing benefits of the plan.

Mayor Martin Rush says that the State Government now has the option of challenging the decision in court.

I think it would be very foolish for the State Government to roll back essentially a process begun by the State Government,” he said.

It approved the LEP (Local Environmental Plan) and raised expectations for developers to progress to develop that land.”

The plan involves more than 130 hectares of land near the Denman town centre.
